These terms and conditions (“Terms”) govern the sale of products (“Goods”) and the provision of installation services (“Services”) by Artis Bathrooms (“we,” “us,” or “our”) to you, the customer (“you” or “Customer”). These Terms override any other terms mentioned in documentation submitted by you or implied by trade custom, practice, or course of dealing. Acceptance of your order by Artis Bathrooms, including phone orders, becomes effective only when confirmed in writing on our order acceptance form, creating a binding contract between you and us.

Please review these Terms thoroughly before placing your order. They explain our identity, how we provide Goods and Services to you, how both parties may modify or terminate the contract, what to do if an issue arises, and other essential details. Orders

1. Order Acceptance: If we cannot accept your order, we will notify you in writing and will not charge you for the Goods or Services. Possible reasons include:

– Goods or Services are unavailable.

– Errors in pricing or descriptions.

– Inability to meet a specified delivery or installation deadline.

2. Order Confirmation: Orders are confirmed only upon receiving a written confirmation from us. This applies to phone orders as well, which are not binding until written confirmation is provided.

3. Order Modifications: Any changes to orders must be requested in writing and are subject to our approval.

 

Pricing

1. Price Validity: Prices quoted (including VAT) are valid for 30 days from the quotation date and may change thereafter.

2. Price Adjustments: We reserve the right to adjust prices without notice after the 30-day period. Changes will not affect confirmed orders.

 

Payment

1. Payment Terms: Full payment in cleared funds is required before delivery and installation.

2. Late Payments: Timely payment is crucial. We reserve the right to charge interest on overdue amounts at 8% above the Bank of England base rate. Delivery and installation may be suspended if payments are overdue.

3. Special Items: Special orders must be prepaid 100%.

 

Cancellation

1. General Right to Cancel: You can cancel the contract in writing for the following reasons:

– Notification of an unacceptable change to the Goods, Services, or these Terms.

– Errors in the price or description of the Goods or Services you ordered.

– Suspension of Goods or Services supply for technical or safety reasons exceeding 3 months.

– Legal right to terminate the contract due to our fault.

2. Bespoke Goods: Orders for bespoke or special Goods cannot be canceled without our written consent. Cancellations will incur costs for work already performed. Bespoke Goods Costs include any incurred costs paid or contracted to third-party suppliers or manufacturers.

3. Restocking Fee:  Returned Goods are subject to a 100% restocking fee and must be returned in original packaging within 48 hours of delivery to avoid additional charges.

 

Delivery and Installation

1. Delivery Costs: Delivery costs will be communicated during the order process.

2. Delivery Timing: We aim to deliver and install as soon as possible, providing an estimated date.

3. Customer Responsibilities: Ensure that personnel are available to receive and offload deliveries. We provide a tailboard kerbside delivery service. You are responsible for arranging competent assistance to off-load items.

4. Failure to Accept Delivery: If you fail to accept delivery, we may terminate the contract and recover losses and additional costs, including storage fees.

5. Delayed Delivery: If delivery is delayed by events beyond our control, we will inform you and take steps to minimize the delay. We are not liable for such delays, but you may cancel the contract and receive a refund for undelivered Goods.

6. Installation Services: Installation services include the fitting of bathrooms as per the specifications agreed upon in the order confirmation. It is your responsibility to ensure the installation site complies with all regulations and is ready for installation. Any additional work required to prepare the site will be charged extra.

7. Site Access: You must provide access to the installation site during agreed hours. If access is not available, any additional costs incurred due to delays will be charged to you.

8. Installation Delays: If installation is delayed due to your failure to prepare the site or provide access, we reserve the right to charge for any additional costs incurred.

 

 

Risk and Title

1. Risk Transfer: Goods remain our property until fully paid. Risk transfers to you upon delivery.

2. Insurance: You must insure the Goods until title passes and hold proceeds of any claims on trust for us.

 

Damage/Shortage

1.  Inspection: Inspect all Goods upon delivery and sign for them in “good condition.” Report any damage or shortages to the driver and confirm in writing within 5 days.

2.  Carrier Deliveries: For carrier deliveries, notify us immediately of any issues and confirm in writing within 5 days.

 

 

Tiles/Natural Stone

1. Quantity: Order sufficient quantities to account for breakages/cuts as exact shade/batch matching for subsequent orders is not guaranteed.

2. Non-returnable: Excess tiles are non-returnable.

 

Disclaimer

 1. Guidance Only: Information provided is for guidance only. Colours may vary slightly from images.

2. Suitability: Confirm with your advisers that Goods are suitable for your intended installation and comply with regulations.

3. Promotion: Our brochure and website promote our Goods and Services in the UK.

 

Complaints

Contact Us: For questions or complaints about Goods or Services, contact us using the details provided. We are legally obliged to supply Goods and Services that conform to the contract.

 

General

1. Force Majeure: We are not liable for failures or delays caused by circumstances beyond our control.

2. Liability: Our total liability is limited to the price of the Goods and Services, excluding economic loss, loss of profit, or consequential damages. For faulty Goods discovered after installation, we will replace them and cover reasonable reinstallation expenses.

3. Use of Personal Information: We will use your personal information to supply the Goods and Services, process payment, and inform you about similar Goods and Services if you consent. We will only share your information with third parties where required by law.

 

Applicable Law

These Terms are governed by the laws of England and Wales, with any disputes subject to the exclusive jurisdiction of the English Courts.
